An Italian colleague who included such imaginary judgments in his brief was therefore faced with a claim under Article 96 of the Italian Code of Civil Procedure, which sanctions damages and fines for party submissions made in bad faith (mala fede) or with gross negligence. The Florence Regional Court took pity and dismissed the claim, stating, among other things, that the fabricated decisions were intended to support a coherent presentation that was made in good faith.
