Labour Law III: Shareholders of an Italian corporation are personally liable for TFR

In Italy, every employee is entitled to a savings benefit from their employer, which is paid out to them upon termination of employment (TFR). If this is not saved and the company is liquidated and dissolved, the shareholders themselves are personally liable for the unpaid benefits, even in the case of a corporation (Srl, Cass. dated January 28, 2025, No. 1934/2025).
