Following a decision by the Federal Labor Court on April 16, 2025 (10 AZR 80/24), employees can also claim their commission entitlement in cryptocurrency (in this case: Ether (ETH)), insofar as this has been agreed as a payment in kind within the meaning of paragraph 107 (2) sentence 1 of the German Trade Regulation Code (GewO). However, the unattachable portion of the remuneration must be paid to the employee in real money. In Italy, the attachable portion of earned income is one-fifth of the earned income; in Germany, it is based on fixed income limits.
