The Federal Labor Court, in its decision of June 3, 2025 (9 AZR 104/24), reiterated that employers cannot pay off employees' vacation time if it is still possible to take it. Therefore, employers who enter into settlement agreements of this type should be aware that the employee's right remains valid in any case.
