Soccer is not common property

According to a ruling by the Federal Constitutional Court (January 14, 2025, 1 BvR 548/22), in future the federal states will be able to claim the additional police costs asserted at so-called high-risk games, where violent clashes between rival fans are to be expected, from the organizer, the German Football League (DFL). The DFL argued and defended themselves that it was the state's responsibility to ensure public safety and order, which should not be remunerated to separate compensation.

The lawsuit was filed by the city-state of Bremen, which had to deploy 1,000 police officers instead of the usual 150 for matches between Werder Bremen and HSV. The ruling applies to all events (rock concerts, sect meetings) where additional police costs are to be expected.
