On May 1, 2025, the first phase of the comprehensive reform of European design law began. This reform aims to adapt the protection of designs registered with the European Union Intellectual Property Office (EUIPO) to modern developments in the digital world.
The reform is divided into three phases and brings numerous innovations to the field of intellectual property. The definition of the term “design” now also includes animations, which encompass dynamic and evolving designs. The term “product” has been expanded to include non-physical objects such as digital products and virtual designs. The protection is extended to 3D printing as a manufacturing process.
A new symbol (D) has been introduced in a circle, which design owners can use on their products to indicate the legal protection of the design and increase the visibility of design protection.
By December 9, 2027, the third phase of this reform will also be completed, requiring Member States to transpose the Design Directive into national law.
