For almost ten years, the client newsletter has regularly reported on proposed legislation that would lead to court proceedings in Germany being conducted in English. On 4 July 2024, the German Bundestag finally passed the so-called Justice Location Strengthening Act, which is intended to allow the federal states to establish commercial courts at higher regional courts and commercial chambers at regional courts in 2025. Italian companies filing lawsuits in Germany would then be able to avoid being at the mercy of the German language. The threshold for the amount in dispute will be €1,000,000. The German Courts Constitution Act and the Code of Civil Procedure have been amended accordingly.
