Certificate may be folded!

A major difference between German and Italian labour law has always been the right to a reference letter after termination of employment. While it is only of secondary importance in Italy, a separate area of law has emerged in Germany, which not only stipulates specific language in terms of content, but also contains formal regulations. For Italian employers who employ staff in accordance with German law, the regulations are barely comprehensible.

The Mecklenburg-Vorpommern Regional Labour Court has now had to deal with the question of whether a certificate may be folded twice or must be sent unfolded in a DIN A4 envelope. It ruled in favour of folding on the condition that “clean and orderly copies or scans” of the folded paper are then possible. This would not be guaranteed if “folds on the copies were visible due to blackening running across the sheet”
